1. Introduction

Welcome to CatholicLegacy.com (the “Site”), which is owned and operated by Relevant Radio, Inc., a Wisconsin corporation. By accessing, browsing, or using our website and services (collectively, "Services"), you accept and agree to be bound by these Terms of Use ("Terms"). Additionally, when using specific services on this website, you shall be subject to any posted guidelines or rules applicable to such services. Relevant Radio may revise these Terms at any time by updating this posting without you being given notice. It is your responsibility to review these Terms occasionally and stop using the site if you disagree with the Terms of Use. Your continued use of the website after any changes constitutes your acceptance of the new Terms.

In these Terms of Use, the words "you" and "you're" refer to each customer, Site visitor, or user, "we," "us," and "our" refer to Relevant Radio, Inc., and "Services" refers to all services provided by us. They include our respective subsidiaries, affiliates, agents, employees, employers, business partners, shareholders, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of services or products under these Terms or any prior agreements between us.

By participating in this site, you acknowledge and accept this agreement. If, for any reason, you do not agree to abide by these terms, we respect your decision not to use this site any longer.

2. Privacy Policy

All information collected from users of our sites is subject to our Privacy Policy. A complete statement of Catholic Legacy’s current Privacy Policy is here: https://catholiclegacy.com/privacy-policy. This Privacy Policy is expressly incorporated into this Agreement by reference to the link.

3. No Attorney-Client Relationship

Relevant Radio operates an online platform that grants access to self-prepared legal documents and templates. It's important to note that using our Services does not establish an attorney-client relationship between you and Relevant Radio or any of its employees. We do not provide legal advice or representation. You represent yourself in any legal matter you undertake after using Relevant Radio’s legal document template service.

4. Not a Substitute for Legal Advice

Our Services are not a substitute for the advice of a licensed attorney, as Relevant Radio is not a law firm and does not perform legal services or offer legal advice as an attorney. While our templates are designed to be accurate and reliable, the law varies by jurisdiction and may be subject to interpretation by courts. While our Site may include educational information on commonly encountered legal issues, we do not ensure the accuracy of the information. We do not evaluate your answers for legal adequacy, nor do we interpret legal matters or offer legal counsel. We refrain from providing opinions or recommendations about your legal rights, remedies, or other aspects of legal situations. Additionally, we do not apply the law to the specific facts of your situation. This Site and Services is not a substitute for the advice or services of an attorney. We recommend consulting a licensed attorney for advice specific to your situation.

5. User Responsibility

WARNING:  The Will form template on the Site is provided for the personal use of the person who is making their own Last Will and Testament (who is legally referred to as the “Testator”). This Will form template is not intended for use by any other party or by any third party. A WILL THAT IS PREPARED OR PROCURED BY, OR SIGNED WITH PARTICIPATION OF, ANY PERSON WHO STANDS TO RECEIVE A SUBSTANTIAL BENEFIT UNDER THE WILL CAN BE LEGALLY CHALLENGED ON THE GROUND OF UNDUE INFLUENCE AND DENIED PROBATE. Even if there is no substantial benefit for the preparer, a person who prepares a Will for a Testator engages in the unauthorized practice of law, which is a crime. Accordingly, if the preparer of the Will is not the Testator, THEN ANY USE OF THIS WILL TEMPLATE IS UNAUTHORIZED. If the Testator is unable to use this Will template, then the Testator should be directed to a licensed attorney to prepare a Will that is suitable for the Testator, and in accordance with the Testator’s intentions for beneficiaries.

  • Minors are not eligible to use the Site or Applications, and we do not want any minor to submit personal information to us. You must be at least 18 years of age and not impaired from entering into a contract to use the Site and Services.
  • You are solely responsible for using our Service, which may only be used for your personal benefit on your own behalf. You agree to use the templates and documents provided by Relevant Radio for lawful purposes only and will review your downloaded forms for accuracy.
  • This Site is only intended to be used in the United States of America, and you agree to comply with all applicable export laws or regulations, including the United States Export Administration Laws and Regulations.
  • All persons who access the Site on your behalf, through your internet connection, or via your login credentials know these Terms of Use and agree to comply with them.
  • You will not use the site to upload, display, or distribute any content that is libelous, defamatory, obscene, pornographic, abusive, impersonating another person or entity, encouraging unlawful behavior, or threatening. Nor will you knowingly or intentionally try to hamper the working of the Site, introduce viruses or other malware.

6. No Guarantee of Results

While Relevant Radio endeavors to keep the Site current, it does not guarantee the templates and documents' accuracy, completeness, or adequacy. The effectiveness of these documents depends on how they are used and the specific circumstances of your case. Relevant Radio is not responsible for any errors or omissions in the documents you prepare using our Services.

7. Intellectual Property

All content and materials provided by Relevant Radio, including but not limited to templates, documents, information, text, graphics, video, logos, icons, images, and software (the “Materials”), are the intellectual property of Relevant Radio. They are protected by copyright and other intellectual property laws. All other trademarks, product names, and company names or logos cited herein are the property of their respective owners.

Except as otherwise expressly provided by Relevant Radio, none of the Materials may be copied, reproduced, downloaded, uploaded, posted, displayed, or distributed in any way, and nothing on the Site shall be construed to confer any license under any of Relevant Radio's intellectual property rights, whether by estoppel, implication or otherwise. Any rights not expressly granted herein are reserved by Relevant Radio.

8. Use License

Relevant Radio grants you a non-exclusive, limited, non-transferable, revocable license to use the Services, which includes the ability to download, view, copy, and print the documents available on this website on any single, stand-alone computer solely for your personal, informational, and non-commercial use, provided that the copyright and trademark notices appearing on any document are not altered or removed where provided.

This permission will automatically terminate without notice if you breach any of the terms or conditions of these Terms of Use. Upon termination, you agree to destroy any downloaded or printed documents immediately.

Unauthorized use of any Materials on this website may constitute a violation of copyright laws, trademark laws, privacy and publicity laws, and communications regulations and statutes. Relevant Radio reserves the right to seek all remedies available at law and in equity for such violations.

Except as otherwise provided in the Terms, you may not, and may not permit others to:

  • Modify, translate, reproduce, sell, license, publish, enhance, reverse engineer, or create derivative works of any Materials or Services.
  • Circumvent or deactivate any safety, security, or other key feature of our Site.

Special Exceptions:

  1. You may share the documents you have created on the Site with attorneys and have them edit them for your specific circumstances. If you are an attorney wanting to use Catholic Legacy for your clients, please get in touch with Catholic Legacy for permission. Relevant Radio wants to assist attorneys in helping people create legally sound documents with particular consideration for the Catholic faith.
  2. You can also share the document prepared for a funeral with the Parish, Funeral Home, or Cemetery providers you are working with related to your loved one’s funeral. They may edit them to enhance their efforts in carrying out their work of helping you with funeral preparations. If you are a Parish Priest, please contact Catholic Legacy to find ways we can partner to make these forms as helpful as possible for your ministry.

9. Users Needing Extra Assistance

Relevant Radio aims to provide full access to its website and product offerings regardless of disability. If you cannot read any part of the Relevant Radio website or otherwise have difficulties using it, please get in touch with our Customer Care Center at (877) 291-0123, and we will do our best to assist you. The services are only available in English. Non-English speakers may use translation tools to read these Terms or to use the Site. Still, in case of any ambiguity or conflict between translations, the English version provided by the Site is authoritative.

10. Limitation of Liability and Indemnification

Except as prohibited by law, you agree to hold Relevant Radio and its officers, directors, employees, and agents harmless from any indirect, punitive, special, incidental, or consequential damages, however, they arise (including attorneys' fees and all related costs and expenses of litigation and arbitration, or at trial or on appeal, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement. This includes, without limitation, any claim for personal injury or property damage arising from this agreement and any violation by you of any federal, state, or local laws, statutes, rules, or regulations, even if Relevant Radio has been previously advised of the possibility of such damages.

Except as prohibited by law, if liability is found on the part of Relevant Radio, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages. Some states do not allow the exclusion or limitation of punitive, incidental, or consequential damages, so the above limitation or exclusion may not apply to you.

The Services are provided "as is" and “as available” basis. This means that Relevant Radio expressly disclaims all warranties of any kind, whether express or implied, to the greatest extent permitted by law relating to the Services on the Site, including but not limited to:

  • Information on the Site is accurate and free of defects as of any particular date.
  • That the Site and any documents or materials provided through the Services are free of computer viruses or other harmful components or conditions.
  • That the Site will be available uninterrupted or be permanently available.
  • Any warranty related to any particular level of quality, ability to meet your needs or a specific purpose.

In no event will Relevant Radio be liable to any party for any direct, indirect, incidental, special, exemplary, or consequential damages of any type whatsoever related to or arising from this Site, including the loss of stored documents. This exclusion and waiver of liability applies to all causes of action, whether based on contract, warranty, tort, or any other legal theories.

11. Governing Law

Any dispute arising from these Terms and your use of the Services or the Site will be governed by, construed, and enforced in accordance with the laws of the State of Illinois, without regard to its conflict of law rules or principles that would result in the application of the laws of any other jurisdiction. Any dispute between the parties not subject to arbitration and cannot be heard in small claims court will be resolved exclusively in the state or federal courts in Illinois, specifically in Lake County. You hereby consent to the personal and exclusive jurisdiction of these courts.

12. Accessing the Website and Account Security

You are responsible to:

  • Set up login and password information on the Site and keep your credentials secure.
  • Log out at the end of a session to keep your account and the Materials secure.
  • Secure your downloads and printed documents.

As a requirement to use the Services, you will be asked to provide certain registration information, and you certify that all information you provide on the Site is accurate, complete, and up to date. If you provide a phone number through the Contact form, Relevant Radio retains the right to contact you via that number, even if such number appears on any State or Federal “do not call” lists.

We reserve the right to withdraw or amend the Site or Services, at our sole discretion, without notice. We will not be liable if, for any reason, all or any part of the Site is unavailable at any time or for any period and retain the right to restrict access to any parts of the Site, for any reason, to any visitor or user. In addition, we reserve the right to remove any content from the Site for any reason.

13. Third-Party Websites and Organizations

This Site may contain links to websites controlled by parties other than Relevant Radio (each a "Third-Party Site"). Relevant Radio works with some partners and affiliates whose sites are linked from Catholic Legacy. There may also be links to other resources with whom Relevant Radio is not affiliated. Some of these organizations may be listed in various sections of the Site, and in this case, it should be known that their presence on the Site is not an endorsement or validation of the Site. These organizations are held harmless from any user actions on the Site.

These links are provided to you only for convenience. Relevant Radio is not responsible for and does not endorse or accept any responsibility for the availability, contents, products, services, or use of any Third-Party Site, any website accessed from a Third-Party Site, or any changes or updates to such sites.

You acknowledge that you bear all risks associated with accessing and using the content provided on a Third-Party Site and agree that Relevant Radio is not responsible for any loss or damage you may incur from dealing with a third party.

Relevant Radio is not affiliated with and does not endorse any other legal template service or website, including “My Catholic Will.”

14. Dispute Resolution; Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY, AS IT REQUIRES YOU AND RELEVANT RADIO TO RESOLVE CERTAIN DISPUTES AND CLAIMS THROUGH ARBITRATION AND LIMITS THE RELIEF WE CAN SEEK FROM EACH OTHER UNLESS YOU OPT-OUT BY FOLLOWING THE INSTRUCTIONS PROVIDED BELOW. THIS ARBITRATION PROVISION PROHIBITS CLASS OR REPRESENTATIVE ACTIONS OR ARBITRATIONS. FURTHERMORE, BY AGREEING TO ARBITRATION, YOU AND RELEVANT RADIO WAIVE THE RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL.

 (a) Arbitration of Disputes. This section applies if we cannot resolve disputes informally. You and Relevant Radio agree to waive the right to sue in court or have a jury trial to the fullest extent allowed by law and resolve any dispute, controversy, or claim arising out of or relating to any aspect of our relationship (collectively, “Disputes”) through arbitration, thus establishing an “Arbitration Agreement” as outlined below.

Disputes include, but are not limited to, those arising from or related to these Terms or our Services and those related to advertising, privacy, data security, and the use of our Site. This Arbitration Agreement applies to all Disputes based on contract, tort, statute, fraud, misrepresentation, or any other legal theory, including Disputes arising before you accepted these or any prior Terms, Disputes that are currently the subject of purported class action litigation in which you are not a member of a certified class, and Disputes asserted against Relevant Radio by those you list as authorized contacts on your order.

(b) No Representative Actions. You and Relevant Radio agree that any dispute or claim between us, including those arising from or related to these Terms or our Services, is personal to you and Relevant Radio and will be resolved solely through individual action. Furthermore, you expressly waive any rights to join a class action/ class arbitration/ other type of representative proceeding as a plaintiff or class member.

(c) Arbitration Procedures. For any dispute between you and Relevant Radio, both parties agree to first attempt to resolve the issue informally using the following process. First, send a written notice of your dispute ("Claimant Notice") via U.S. certified mail to Relevant Radio, ATTN: Catholic Legacy Dispute, 680 Barclay Blvd, Lincolnshire, IL 60069; a courtesy copy of the Notice should also be sent by email to info@RelevantRadio.com. The Claimant Notice must include (a) your name, residence address, email address, and telephone number; (b) a description of the nature and basis of the dispute; and (c) the specific relief sought.

If we are unable to resolve the dispute within thirty (30) days after notice is provided, either party may submit the dispute to binding and confidential arbitration administered by the American Arbitration Association (“AAA”) or, in limited circumstances, pursue resolution in court. All disputes submitted to AAA will be resolved through binding arbitration before a single arbitrator. Unless otherwise agreed in writing, arbitration proceedings will be held in Lake County, IL. However, if you are a Consumer, you may choose to have the arbitration conducted in your county of residence. For this section, a “Consumer” is defined as a person using the Services for personal, family, or household purposes who has paid financially for the Services, not including donations, to Relevant Radio.

If you are a Consumer, we agree to use the AAA Consumer Arbitration Rules. If you are not a Consumer, we agree to use the AAA Commercial Arbitration Rules, including the Expedited Procedures, for all disputes valued at $75,000 or less. In either event, the AAA fee schedules will be used. The AAA Consumer and Commercial Arbitration Rules are available on the AAA’s website at adr.org/Rules, and these rules are hereby incorporated by reference into this Arbitration Agreement. By agreeing to these terms, you acknowledge that you have read and understand the applicable AAA Arbitration Rules, or you waive your right to read the AAA Arbitration Rules and any claim that these rules are unfair or inapplicable.

 (d) Individualized Arbitration Proceedings and Remedies. You and Relevant Radio agree that these Terms affect interstate commerce and that the Federal Arbitration Act (FAA) will govern the enforceability of this section, both substantively and procedurally, to the maximum extent permitted by applicable law. Within the limits set by the FAA, these Terms, and the AAA Rules, the arbitrator will have exclusive authority to grant any relief that would otherwise be available in court and to make all procedural and substantive decisions regarding any dispute.

This includes decisions related to the interpretation or application of this Arbitration Agreement, such as the enforceability, revocability, or validity of the Arbitration Agreement or any part of it. The arbitrator will conduct only individual arbitration and may not consolidate multiple individuals' claims, preside over any class or representative proceeding, or preside over any proceeding involving more than one claimant.

Unless otherwise mandated by law, any remedies sought by either Party will be limited to the prevailing Party’s actual monetary damages and will exclude punitive or consequential damages. Any arbitration award under this clause shall not include any injunction or directive to any party other than the payment of a monetary amount.

(e) Confidentiality. The exchange of non-privileged information relevant to the dispute will be permitted during arbitration. We agree to collaborate in requesting the arbitrator's protection for confidential, proprietary, trade secret, or sensitive information, documents, testimony, and materials that may be disclosed or discovered during arbitration. This protection should be sought before exchanging or discovering such information, ensuring that all sensitive materials remain confidential throughout the arbitration process. Additionally, neither a Party nor an arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties.

(f) Opting Out of Arbitration. You can opt out of binding arbitration within 30 days of initially accepting the terms of this section. To do so, you must send a written Notice of Opt Out via U.S. certified mail to Relevant Radio, Inc., ATTN: Catholic Legacy Arbitration, 680 Barclay Blvd, Lincolnshire, IL 60069. Also, please email a courtesy copy of the notice to Info@RelevantRadio.com.

To be valid, the Notice of Opt Out must include your full name and address and clearly state your intent to opt out of binding arbitration. Even if you opt out of binding arbitration, you agree to resolve disputes according to these Terms of Use. Importantly, you agree that any such action will be brought individually and not as part of a class arbitration, class action, or any other representative proceeding.

(g) Additional Terms. If any part of this Section is deemed unenforceable or illegal, the following provisions apply:

  1. The unenforceable or illegal provision will be removed from these Terms.
  2. The removal of such a provision will not affect the remainder of this Section or the parties' ability to enforce arbitration for any remaining claims on an individual basis as outlined in this Section.
  3. If any claims must be handled on a class, collective, consolidated, or representative basis, they must be litigated in a civil court of competent jurisdiction, not arbitration. Any such litigation will be stayed pending the outcome of individual claims in arbitration.
  4. You must file any cause of action or claim related to these Terms of Use or Site within one (1) year from the date the issue arises. If you fail to make this filing, your right to pursue the action or claim will be permanently lost.

Should you seek public injunctive relief against Relevant Radio, that specific claim must be separated from the arbitration and brought to court in accordance with these Terms of Use.

You and Relevant Radio agree that the state or federal courts in Lake County, Illinois, have exclusive jurisdiction over enforcing any arbitration award made under this Arbitration Agreement.

15. Compliance with Intellectual Property Law

Relevant Radio will act upon receipt of proper notification of claimed copyright infringement to remove or inactivate access to the allegedly infringing content. If you have evidence, know, or have a good faith belief that your rights have been violated and you want the content deleted, edited, or disabled, you must provide the Relevant Radio with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if a single notification covers multiple copyrighted works at a single online site, a representative list of such works.
  3. Identification of the material claimed to be infringing or being the subject of infringing activity, which is to be removed or access to which is to be disabled, along with information reasonably sufficient to permit the service provider to locate the material.
  4. Information reasonably sufficient to permit the Relevant Radio to contact you, such as an address, telephone number, and, if available, email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

The above-written information must be sent to Relevant Radio, Inc., Attn: Copyright Dispute, 680 Barclay Blvd, Lincolnshire, IL 60069; a courtesy copy of the Notice of Opt Out should also be sent by email to Info@RelevantRadio.com. We agree to settle unresolved disputes via the Arbitration Agreement in these Terms.

16. Waiver and Severability

Relevant Radio’s decision not to enforce any term or condition of these Terms of Use at any time shall not be considered a waiver of that term or condition or any other term or condition. Additionally, the Relevant Radio’s failure to assert any right or provision under these Terms of Use does not constitute a waiver of such right or provision.

Should any provision of these Terms of Use be deemed invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, that provision will be removed or limited to the minimum extent necessary. This ensures that the remaining provisions of these Terms of Use remain fully effective and enforceable.

17. Acknowledgement

BY USING THE SITE OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE AND AGREE TO BE BOUND BY THEM. Relevant Radio, Inc. is located at 680 Barclay Blvd, Lincolnshire, IL 60069.
